Terms of Service
These Terms of Service (“Terms”) govern the use of the Haven Drive mobile application and related services (“Application”) provided by:
Traxware s.r.o.
Czech Republic
(“Company”, “we”, “us”, “our”)
By installing, accessing, or using the Application, you agree to these Terms.
1. Informational Purposes Only
The Application is provided solely for informational and recreational purposes.
The Application:
- is NOT a certified navigation system
- is NOT a safety device
- is NOT approved for emergency use
- is NOT guaranteed to provide accurate or uninterrupted information
Any displayed information including but not limited to:
- speed
- altitude
- heading
- compass orientation
- GPS position
- trip statistics
- telemetry
- route history
may be inaccurate, delayed, incomplete, unavailable, or incorrect.
Users must always rely on:
- official vehicle instruments
- traffic regulations
- road signage
- personal judgment
- safe driving practices
2. Driver Responsibility
The driver is solely responsible for the safe and lawful operation of the vehicle.
Do not operate or interact with the Application while driving unless it is safe and lawful to do so.
The Company is not responsible for:
- distracted driving
- traffic violations
- collisions
- injuries
- fatalities
- property damage
- or any consequences arising from the use or misuse of the Application
3. No Warranties
THE APPLICATION IS PROVIDED “AS IS” AND “AS AVAILABLE”.
TO THE MAXIMUM EXTENT PERMITTED BY LAW, THE COMPANY DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO:
- MERCHANTABILITY
- FITNESS FOR A PARTICULAR PURPOSE
- NON-INFRINGEMENT
- ACCURACY
- RELIABILITY
- AVAILABILITY
We do not guarantee that the Application will:
- operate without interruption
- be error-free
- be compatible with all devices
- or provide accurate information
4. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, THE COMPANY SHALL NOT BE LIABLE FOR:
- direct damages
- indirect damages
- incidental damages
- consequential damages
- special damages
- punitive damages
- loss of profits
- loss of data
- vehicle damage
- personal injury
- or any other losses arising from the use or inability to use the Application
This limitation applies regardless of:
- legal theory
- negligence
- contract
- tort
- or otherwise
5. Device and Third-Party Dependency
The Application depends on:
- Android
- Android Auto
- GPS services
- phone hardware
- sensors
- Google Play Services
- third-party APIs
- and other external systems
The Company is not responsible for failures caused by third-party platforms, services, hardware, or operating system behavior.
6. Local Data Storage
Location history, trip logs, and exported telemetry data are stored locally on the user’s device unless explicitly exported or shared by the user.
The Company does not intentionally collect or store users’ location history on developer-controlled servers.
Users are solely responsible for:
- managing exported data
- backups
- sharing of exported files
- and protection of locally stored information
7. Subscriptions and Billing
Some Application features may require a paid subscription.
Billing and payment processing are handled by Google Play and are subject to Google’s terms and policies.
The Company does not directly process payment card information.
Subscription pricing and features may change at any time.
8. Intellectual Property
The Application, including its software, branding, graphics, and content, is owned by the Company and protected by applicable intellectual property laws.
Users may not:
- reverse engineer
- redistribute
- resell
- modify
- or exploit the Application except as permitted by law
9. Termination
We may suspend or terminate access to the Application at any time without notice.
We may discontinue the Application or any feature at any time.
10. Governing Law
These Terms shall be governed by the laws of the Czech Republic.
Any disputes shall be subject to the jurisdiction of Czech courts.
11. Changes to These Terms
We may update these Terms from time to time.
Continued use of the Application after changes become effective constitutes acceptance of the updated Terms.
